Surely this isn't legitimate, is it? Charging postage for something that should be a download I thought. Can you not only buy this via Mr Wagener's website?

Is there a general consensus on selling com profiles that you bought? such as you buy one copy, you sell one copy, on a usb stick, and having part of the sale stipulate only one copy is allowed? There are a lot of sellers these days, so it may not always be clear what the agreement was. Hard to police for sure, good on ya for looking out for him... Tho plenty of decent folk out there to make up for the sketchy ones...
wow didnt see nov 2015...
powerhead for 5k? sounds a bit greedy, but legal, ppl can charge what they want....
wow, will wait a long, long time.... any reason someone can get these prices besides finding buyers that dont know normal prices?
-
he want s14000 for a minimoog i dont understand what a ripoff artist
-
This is really ridiculous.
Thanks for reporting the auction. -
i think the issue is this , that you can keep a copy and that makes it a bad thing ,
if there was only 1 copy like hardware i see no issue in selling them if you bought them originally , like a used car, but since he probably made copies ..... it doesnt work well -

Yes
Also most seller state in there commercial condition, that you buy the profiles for your own use but not for futher selling.
I wonder sometimes, when People want to sell their Kemper and make advertizing with the amount of professional profiles they intend to send with.
This seemed to be a grey area. -

This seemed to be a grey area.I don't think it's actually stated on Michael Wagners site - I coudlnt' find it at least.
Also, I think some legislation might overrule such terms of use - I'm not sure if they can put limits on the resale in the EU, for instance. This applies to software and music purchased digitally (I think), but of course I don't know about profiles.
-
I really don't think there can be a law made against resale , it might be morally a gray area. but you are allowed to sell anything you own once you buy it .
you can buy any computer software and resell it this will be considered no differently than software. Microsoft cant really make it illegal for a person to sell a second copy of windows 7 , you can pick one up at a local second hand shop or thrift shop Ive seen software sold at secondhand book stores its perfectly legal .
-
Yeah. Bashing reselling because one might potentially keep a copy is like bashing a table knives seller for selling "deadly arms"...
-
there is a big difference between buying a car and reselling it vs. LICENSING profiles for your use, then charging others access to those profiles. digital goods aren't often sold like a product but charged a license for use. maybe the license is legally transferable, but there are often good reasons it shouldn't be and I feel the copyright holder should be able to write that into the license/contract.
i wonder if anyone is selling mp3's on ebay...

This. Licensing to use a profile is not the same as owning it. Everybody 'buying' profiles (i.e. buying licenses to use them) shoud be clear about this. -

I did not purchased Wagner Profiles. (till now)
Commercial conditions are not determined by Law.
They are formulated by the vendor. If you buy you accept them.
Maybe there are some restriction by law so you can not include everything in this conditions. But this restriction is definitly not overruled by law. -

But this restriction is definitly not overruled by law.Not necessarily true - consumer protection laws in Denmark CAN'T be limited by "professional" sellers; for instance, you ALWAYS have 2 years warranty (not actually the right word, but still), and 14 days return right, no matter what the seller might state (this does not apply to all products, but I'm just trying to make a point here). Operating systems such as Windows is also something you buy a LICENSE to use; but I believe you still have the right to resell (transfer the license), by law.

Yes also in my opinion it is possible when it's stated in the condition - but in that case you can not use it anymore .
I think to sell a licence just for use is possible. But anyway, this topic for me is not really clear. But it does not harm me.
I would not sell further a bought Profile if I will use it further by myself.
Not because of possible law condition just because I think it's not fair. -
